TERMS OF USE
This website is owned by and operated by or on behalf of Sanofi-Aventis Singapore Pte Ltd (Company Registration Number: 199703242Z) (hereinafter referred to as “Sanofi”).
This is a binding legal agreement between you and Sanofi that sets forth the terms and conditions (hereinafter the “Terms”) that apply to all users visiting https://www.getinsulinright.sg, including all content, features, functionality, programs and services provided in or through the website (hereinafter “the Site”). By accessing and using the Site, you represent to Sanofi that you have read, understood and agree to these Terms with the intent to be legally bound by them. Sanofi may, at any time, revise these Terms and you are bound by any such revisions and should, therefore, periodically visit this page to review the then current Terms.
By using the Site, you represent and warrant to Sanofi and agree that you will use the Site only in a manner consistent with any applicable ethical, regulatory, statutory and legal requirements.
1. Scope of the Site
The Site is designed to comply with laws and regulations of Singapore. Although the Site may be accessible outside Singapore, it is intended for access and use by users based in Singapore ("Users") for purposes including but not limited to the following:
- access to general educational information and materials related to diabetes and diabetes treatment developed by Diabetes Singapore;
- registration and participation in the educational modules on the aforementioned topics (“Modules”);
- any other purposes provided as prescribed and determined by Sanofi from time to time.
2. Nature of information
The Site may contain information relating to medical or healthcare advice which is provided for the purpose of informational and educational exchange only. While we hope you find the Site helpful, it is not a substitute for advice provided by consultation with a doctor or other qualified HCPs. The advice given on this Site is of a general nature only and Sanofi makes no claims or warranties as to its accuracy or usefulness. Users should not use the information contained herein for diagnosing a health problem, condition or disease. In using the Site, you agree that neither Sanofi nor any other party is or will be liable or otherwise responsible for any decision made or any action taken or any action not taken due to your use of any information presented through the Site.
The Site may offer opinions by experts consulted in a particular field in relation to the content of the Site or excerpts from press articles. Any such information solely represents the opinion of the expert or the publication and is not necessarily the opinion of Sanofi. Sanofi is not responsible for the accuracy or completeness of any such information and opinions.
3. Links to other sites
The Site may contain links to third-party sites. The liability of Sanofi shall not be in any way incurred by a third-party site that can be accessed via the Site. 4. Intellectual property
The layout and each of the components, including but not limited to trademarks, logos and domain names, appearing on the Site, are protected by current laws on intellectual property, and belong to Sanofi or its affiliated companies, or their use is the subject of authorisation from third party.
No component of the Site may be copied, reproduced, altered, edited, downloaded, denatured, transmitted or distributed in any way whatsoever, on any medium whatsoever, in whole or in part, without the prior written consent of Sanofi, except solely for use for press requirements conditional on compliance with intellectual property rights and any other property rights that are mentioned. Copying for private use is only authorised for your own personal, private, non-commercial use, on your personal computer.
All copyright and other proprietary notices contained in downloaded materials must be retained. The following statement should appear on any authorized copy of all or part of the content of the Site: "COPYRIGHT 2021 – Sanofi-Aventis Singapore Pte Ltd - ALL RIGHTS RESERVED".
Any authorised use of items composing or shown on the Site must not be denatured, changed or altered in any way whatsoever.
Sanofi or its affiliated companies reserve the right to take legal action against any infringement of its intellectual property rights.
5. Availability of the Site
You acknowledge (i) that it is technically impossible to provide the Site free from any defects and that Sanofi cannot undertake to do so; (ii) that defects may lead to the Site being temporarily unavailable; and that (iii) operation of the Site can be affected by events and/or matters that Sanofi does not have control over, for example, means of transmission and communication between you and Sanofi and between Sanofi and other networks.
Sanofi and/or its suppliers may, at any time, alter or interrupt, temporarily or permanently, all or part of the Site to undertake maintenance and/or make improvements and/or changes to the Site. Sanofi is not responsible for any alteration, suspension or interruption of the Site.
6. Hardware and Compatibility
Sanofi does not represent or warrant that the Site (or any updates) is compatible with any hardware or software versions or applications, including any specific versions of your phone, PDA, tablet, computer, or its specific operating system.
7. Updates
Sanofi may choose to provide updates to the Site from time to time in its sole discretion. Sanofi does not represent or warrant that any future updates to the Site will provide the same functionality that is provided by the current version of the Site.
8. Use of the Site
When you register to access and participate in the Modules, you will create an account by providing details such as a username and password. Thereafter, an email confirmation of your registration together with your account details including unique identification / code and password will be sent to you at the email address that you have provided. Your account for participation in the Modules is for your own exclusive use. You must keep both your username and password (and any other login details) secret and not share with anyone else or allow use by others. You must not use an account that belongs to any other person. You are responsible for any activity on the Modules arising out of any failure to restrict access to your account details including unique identification and password, and may be held responsible for any losses arising out of such a failure. You must inform Sanofi immediately if you suspect any unauthorized use of or access to your account. Sanofi should not be held responsible if you suffer any harm or loss arising from your failure to observe and comply with requirements set forth in this section.
We do not intend to receive confidential information from you through the Site. Consequently, except for personal data mentioned above, any information, whatever its form, including document, data, graphic, question, suggestion, concept, comment or others, that you send us via the Site, will not under any circumstances be deemed confidential. The act of sending it to us alone gives us the right to use it, reproduce it, publish it, alter it or send it with a view to dealing with your request.
You warrant that any information you provide to Sanofi or to any third party via the Site (if any) (i) is accurate, correct, complete and reliable, (ii) does not breach the intellectual property rights of a third party, (iii) does not defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others, and/or (iv) does not disseminate any defamatory, obscene, indecent, misleading or unlawful material or information, and that you will indemnify Sanofi for any loss or damage that arises as a result of any such breach. Sanofi assumes no responsibility or liability arising from the content of such messages and/or information, including but not limited to responsibility or liability for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, misrepresentation or inaccuracy contained in any information hereto.
You must not alter, damage or deface the Site or add any unauthorized material to the Site.
There might be other rules regarding use of the Site established from time to time by Sanofi on the Site in general or for specific sections and you agree to observe and abide by them in your use of the Site.
9. Reporting An Adverse Event or Product Safety Concern or Requesting Medical Information
The Site is not intended to be used to report adverse events or product safety concerns or request for medical information. 10. Privacy Notice

Sanofi respects your rights to such data and has established a privacy notice governing Sanofi’s collection and use of your personal data (“the Privacy Notice”). The Privacy Notice is hereby incorporated into these Terms. You are required to read through the Privacy Notice in your course of registration on the Site and will be granted access to the Site only if you have acknowledged your understanding and agreed to the Privacy Notice. 11. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, EVERYTHING ON THE Site IS PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SANOFI AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS AND LICENSORS MAKE NO WARRANTY THAT (I) THE SITE WILL MEET YOUR REQUIREMENTS; (II) THE SITE WILL BE UNINTERRUPTED, UP-TO-DATE, SECURE OR ERROR-FREE; (III) THE INFORMATION OBTAINED BY YOU THROUGH THE SITE WILL MEET YOUR EXPECTATIONS; AND (IV) ANY ERRORS IN THE SITE WILL BE CORRECTED.

12. Limitations on Liability
Sanofi strives to the best of its ability to ensure that information published on the Site is accurate and up-to-date. It reserves the right to correct content at any time, without prior notice. However, Sanofi cannot guarantee that the information available on the Site is accurate, correct, up-to-date or complete.
Except for property damage resulting from gross or intentional negligence by Sanofi, the latter declines any liability:
- for any inaccuracy, error or omission as regards information available on the Site;
- for any damage resulting from fraudulent intrusion by a third party resulting in an alteration of information or items made available on the Site
- and more broadly, for any property damage or consequential loss, for any reason, of any origin, nature or with any consequences whatsoever, even if Sanofi had been warned of the possibility of such damage or loss, caused (i) because of any access to the Site or because it was impossible to access it, (ii) because of the use of the Site, including any harm or virus that may infect your computer or any other property, and/or (iii) because of the credence given to any information coming directly or indirectly from the Site.
13. Termination of Rights
Your rights under these Terms will automatically terminate if you fail to comply with any term of these Terms. In the case of termination, you must cease all use of the Site. Sanofi may immediately revoke your access to the Site. Sanofi’s failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of its rights.
Despite the termination of use, you agree you will continue to be bound by the Terms in respect to use of downloaded materials, intellectual property, limitation of liability, warranties, disclaimer of warranties, governing law and dispute resolution.
14. Indemnity
You hereby agree to defend, indemnify and hold harmless Sanofi and the Sanofi Group and their respective officers, directors, employees, and agents for, from and against any claim, suit, proceedings, loss, liability, damage, cost and expense (including, without limitation, costs of investigation and reasonable legal fees and expenses), directly or indirectly relating to, resulting from or arising out of: (a) any breach by you of these Terms; (b) any negligent act, omission or wilful misconduct by you in connection with your registration for an account (if any) and/or use of the Site; and/or (c) any violation by you of applicable law.
15. Modifications to these Terms
Sanofi reserves the right to modify the Terms, by (i) posting revised Terms on and/or through the Site, and/or (ii) providing advance notice to you of material changes to the Terms, generally via email where practicable, and otherwise through the Site (such as through a notification on the main screen page of the Site). Modifications will not apply retroactively unless required by law.
We may sometimes ask you to review and to explicitly agree to or reject a revised version of the Terms or the Privacy Notice. In such cases, modifications will be effective at the time of your agreement to the modified version of the Terms or the Privacy Notice. If you do not agree to the modifications, you are not permitted to use the Site. In cases where we do not ask for your explicit agreement to a modified version of the Terms or the Privacy Notice, the modified version of the Terms or the Privacy Notice will become effective as of the date specified in the Terms or the Privacy Notice. Your use of the Site following that date constitutes your acceptance of the terms and conditions of the Terms or the Privacy Notice as modified. If you do not agree to the modifications, you are not permitted to use, and should discontinue your use of, the Site.
16. Governing Law
These Terms are governed by the laws of Singapore, without regard to its conflict of laws principles or your place of residency. You agree that any dispute arising from or relating to these Terms should be brought exclusively to a competent court of Singapore for resolution.
17. Miscellaneous
If any provision of these Terms is found to be unlawful, void, invalid or unenforceable, it will be enforced to the extent permissible and, to the extent unlawful, void, invalid or unenforceable, such provision shall be deemed modified to the most limited extent necessary to be lawful, valid and enforceable, in accordance with applicable law, while still as fully as possible carrying out the intent of the original provision, and the remainder of these Terms will remain in full force and effect. Failure by Sanofi to prosecute any right with respect to a default hereunder will not constitute a waiver by Sanofi of the right to enforce rights with respect to the same or any other breach. These Terms constitute the entire agreement between you and Sanofi with respect to, and supersedes any previous oral or written communications or documents concerning, the subject matter of these Terms. In no event will any additional or inconsistent term in any purchase order or similar document submitted by you modify the terms of these Terms.

Pixel Tags |

5. WILL PERSONAL DATA BE TRANSFERRED OUTSIDE SINGAPORE? |

In particular, Sanofi may transfer your Personal Data to our oversea affiliate(s) where our information technology storage facilities and servers may be located. At all times, your personal data will be treated by Sanofi and our authorized employees, agents and third parties as confidential information. |
Safeguards for international transfers of personal data: In cases where Sanofi needs to transfer Personal Data outside Singapore for the Purposes described above, it shall ensure that adequate safeguards, as required under applicable data protection legislation, will be implemented. In this respect and in particular, for intra-group transfers of Personal Data implemented for clinical studies and pharmacovigilance purposes, Sanofi has implemented and shall apply its “Binding Corporate Rules” validated by the EU Data Protection Authorities. |

6. HOW WILL PERSONAL DATA BE STORED? |
Sanofi stores your Personal Data in secure operating environments, databases, servers and tools (within Singapore or outside Singapore), which are only accessible to authorized Sanofi employees, agents and third parties. Sanofi undertakes to observe generally accepted industry standards and practices in the storage of your personal information. |
We may also aggregate, pseudonymize or anonymize Personal Data to ensure that no personally identifiable information is communicated to third parties. However, please be aware that there is always some risk involved when submitting data over the Internet and that Sanofi cannot guarantee that the Site is 100% safe from illegal tampering or “hacking.” Any data transmitted over the Internet may be at risk. |
7. HOW LONG WILL PERSONAL DATA BE RETAINED? |
We may retain your Personal Data for as long as it is necessary to fulfil the purpose for which it was collected, or as required or permitted by Applicable Laws. We will cease to retain your Personal Data, or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the Personal Data was collected, and is no longer necessary for legal or business purposes. |
